Online Gaming Bill 2025 Introduced by Ashwini Vaishnaw: E-Sports Promoted, Money-Gaming Banned

On August 20, 2025, Union Electronics & IT Minister Ashwini Vaishnaw introduced the Promotion and Regulation of Online Gaming Bill, 2025 in the Lok Sabha. The bill, approved by the Cabinet earlier, proposes sweeping reforms that could transform India’s booming online gaming sector.

Key Provisions and Framework

Ban on Real-Money Games

The bill enforces a complete ban on online games involving monetary stakes—regardless of whether they are skill-based or chance-based—as well as their promotion, financial facilitation, and advertisements. Violators could face up to 3 years in prison and fines of up to ₹1 crore. Promoters and advertisers may face penalties of up to 2 years in prison and ₹50 lakh fines.

Empowering Authorities

To enforce the ban, authorities are granted warrantless search and arrest powers across a broad definition of “any place,” including digital assets and virtual spaces.

Dedicated Regulatory Structure

The bill envisages the creation of a centralized regulatory authority—likely termed the National Online Gaming Commission—to license gaming platforms, register games, and categorize them, promoting clarity across different game types.

Promotion of E-Sports and Social/Educational Games

Recognizing their growing significance, e-sports are officially promoted under the bill. The Ministry of Youth Affairs & Sports will frame regulations for e-sports, while the Ministries of Electronics & IT and Information & Broadcasting will support the growth of safe, culturally relevant, and educational social games.

Industry Response

Online gaming associations have raised concerns about the bill’s impact. They warn that a blanket ban could result in:

Loss of nearly ₹20,000 crore in tax revenue annually.

Massive job cuts and business closures—estimated at over 200,000 jobs and 300 startups.

A surge in players using unsafe offshore gaming platforms.

Driving Factors for the Bill

The government cites several pressing reasons for the reform:

Addiction and harm: The addictive nature of money-based games has led to mental health issues, financial ruin, and even suicides—especially among youth.

Fraud and national security: These platforms can be exploited for money laundering, financial fraud, and even communication by extremist groups.

Consumer protection: A uniform national framework is needed to replace inconsistent state-level regulations and align with evolving digital realities and global best practices.
