India will be implementing a new rental regulations for the year 2025 which will be delineating tenants and landlords - the former getting most of the protections. The new laws will enable capping of security deposits, making rent adjustments easier, and setting up of proper rules around property access and maintenance.

With the new rules in place, property owners are no longer able to ask for a security deposit that is more than equal to two months' rent. The renter also receives better protection legally as a result of this change; hence, he/she can never be forced to leave the place without going through a legal process properly.

The tenancy contracts will have to be registered digitally with the tax department and will be valid and stamped online within 60 days after signing. House owners can raise rent only once in a period of 12 months and must give a minimum written notice of 90 days before any increase.

The property access conditions have been made more stringent as well. Landlords are required to provide a written notice to their tenants at least one day before they come to the house for checking or fixing things. If there is an urgent repair that must be done, the tenant has to alert the landlord. In case the landlord does not fix it within a month, the tenant can get it done and take the amount from rent.

Moreover, certain acts of landlords are considered wrong under the new regulations. Changing locks, stopping the flow of water and electricity, or scaring off the tenant are now regarded as punishable actions. The government states that these steps have been undertaken to achieve fairness, i.e., to guarantee rights for the tenants without depriving landlords of their interests.

Rental market is expected to be more transparent with the new legislation. With the digital registry of agreements and the formalized rent hikes, the disputes are expected to go down, resulting in legal clarity for both sides.

Besides, the tenants are the ones who have to get acquainted first with the online registration procedure. Additionally, they must maintain proper records of all dealings with the landlords to protect their rights under the new regulations and ensure compliance.
