In a significant decision, the Rajasthan High Court has declared that two adults who consent to the relationship can live together, even if the marriageable age is not yet reached. The court pointed out that ages cannot be a barrier for the exercise of constitutional rights.
This ruling came from the bench of Justice Anoop Dhand who was hearing the case of two young people from Kota, an 18-year-old girl and a 19-year-old boy. The couple sought court's help claiming they did not want to live separately and had even made a live-in agreement on October 27, 2025.
As per the petitioners, the girl's family was against their relationship and had warned them of dire consequences. They said that the police at Kota did not take their complaint seriously.
During the court proceedings, the public prosecution's argument put forward by Vivek Choudhary was that since the man has not yet turned 21 — the minimum age for marriage for men — he should not be allowed to be in a relationship.
But the court overruling this argued that the right to life and personal liberty as enshrined in Article 21 of the Constitution cannot be fettered merely on the ground that the couple is below the marriageable age.
This judgement reiterates the fact that the young adults willing to live together can make decisions regarding their relationships without being disturbed unnecessarily.
