How New UK Immigration Rules, Including English Language Requirements, Will Affect Indians

UK Prime Minister Keir Starmer has revealed a comprehensive overhaul of the country’s immigration policies, aiming to significantly cut net migration. These reforms are expected to have substantial implications, particularly for Indian nationals.

Changes in Residency and Citizenship

Instead of the present five-year residency requirement, the new "contributions-based" concept for citizenship requires migrants to have lived in the UK for ten years prior to applying. People who make a "high contribution" to society, such highly qualified doctors, engineers, and technologists, will be exempt. It is anticipated that these adjustments will result in a yearly decrease of about 100,000 immigrants.

The director of the University of Oxford's Migration Observatory, Dr. Madeleine Sumption, said the new regulations are expected to boost visa-fee earnings but might not have a major effect on overall migration levels.

Language Requirements in English

Adult dependents traveling with employees or students will be subject to new English language requirements. In an effort to facilitate assimilation and employment, dependents will have to prove they can speak basic English in order to be granted visas. Since many skilled worker visa recipients have brought family with low levels of English proficiency, the full impact of these regulations is still unknown, even though they may have an impact on the number of visas issued, particularly for dependents.

Effects on the Healthcare Industry

One significant modification is the gradual cessation of hiring care workers from abroad by 2028. This may have an impact on the migration wave, especially from South Asian nations like India, which have been essential to the Health and Social Care visa program.

Adaptations for Foreign Students

Currently allowing international students to work in the UK for up to two years after graduation, the post-study Graduate Route visa will now only be valid for 18 months. Since Indian students make up one of the largest groups of international students in the UK, this is probably going to have a big effect on them. In order to further burden students, the administration is also thinking of imposing a tuition charge on institutions of higher learning.

Expense Increases for Employers

Employers must now pay a 32% higher immigration skills charge when they sponsor skilled individuals as a result of the policy. This might make it more expensive to hire talent from outside, which would have an impact on sectors that depend on highly qualified foreign labor.

Human Rights and Refugees

Limiting asylum seekers' access to Article 8 of the European Convention on Human Rights, which safeguards the right to family life, is another goal of the administration. As a result, there would be fewer petitions for asylum classified as "exceptional." There will likely be more adjustments to asylum later this year.

Record immigration numbers have raised public worries, putting pressure on Starmer's government to address both legal and illegal immigration. With right-wing parties gaining ground in the polls and focusing on tougher immigration laws, his party is facing increasing opposition.
